If you are driving on public roads and not federal property, you may consult with your attorney before you take the test. This must happen within at least two hours if the officer suspects you of drunk driving.
An ignition interlock device is a breathalyzer installed in your vehicle. It requires that you breathe into it before starting your car and disables your ignition if it detects alcohol. A lockout period follows so that you have to wait before trying again. This lockout increases in length with each failed attempt.
While driving, the ignition interlock will request rolling retests. These ensure that the person whose breath started the car is the same person who is driving it. If this breath test fails, an alarm will sound until the driver turns off the ignition. For safety reasons, they do not automatically shut down the car, but many do record these events. Failure to remain compliant can extend the requirement for the device. You also have to remain violation free for at least three months after the device is removed.
Points remain on your license for two years. You will receive a Notice of Suspension if you accumulate more than 8. If you accumulate 12 or more, you will receive a Notice of Revocation.
What do I do if I receive a Notice of Suspension or Revocation?
If you receive a Notice of Suspension or a Notice of Revocation and your points are related to a DWI or DUI, you can:
- Accept the suspension or revocation. In this case, you must return your license to the MVA before the date on the notice.
- Request a hearing. If you feel the notice is unjust, you can request a hearing to contest it. You must file your request according to the instructions on the notice within 15 days of receipt.
- Apply for the Ignition Interlock Program. In this case, you can keep your license though it will have new restrictions. All program guidelines will be sent with the notice.

Courts typically require that you complete a state-certified alcohol education program before getting your license back. If you participate in the ignition interlock program, you must successfully complete its requirements, as well.
